We appreciate your interest in our company and our products and services and would like you to feel secure when visiting our website, also with regard to the protection of your personal data. We take the protection of your personal data very seriously. General information on the scope and purpose of the processing of personal data on our websites

Personal data is information about your personal and factual circumstances. This includes, for example, information such as your name, address, telephone number and e-mail address. In principle, it is not necessary for you to actively disclose personal data in order to use our website.

However, when you visit our website, the following data, for example, is stored anonymously: Name of your internet provider, number of visits to our websites over the course of the day and week, number of visits per page, average time spent per page, number of feedbacks, website from which you visit us and your IP address. This data is analyzed to ensure trouble-free operation of the website and to improve our offering

Personal user profiles are not created.

If you make use of our services, we will only collect the data (e.g. name and address) that we need to provide these services. If we ask you for further data, this is voluntary information.

 

Children

It is not in our interest to collect personal data from children under the age of 16. We do not knowingly or intentionally collect data about children and we are aware that the processing of children's personal data is only permitted with the consent of their parents or guardians. If you are of the opinion that we have collected data about your child, you as the legal guardian can inform us of this at datenschutz@econ-solutions.de. The data will then be deleted.

 

Purpose of processing

We process (in particular collect, use and store) your data for the following purposes

  • a) in accordance with Art. 6 para. 1 lit. b) GDPR to answer your inquiries, process your orders or provide you with access to certain information or offers.
  • b) pursuant to Art. 6 (1) (f) GDPR to protect our legitimate interests or those of third parties, in particular companies of the MVV Energie Group, including in the context of advertising or market research, to improve services, to offer customized products or to provide credit information and to investigate or prevent criminal offences (e.g. electricity theft).
  • c) in accordance with Art. 6 para. 1 lit. a) GDPR within the scope of your consent, if you have given us such consent.
  • d) in accordance with Art. 6 para. 1 lit. c) GDPR due to legal requirements that apply to us as a company, in particular commercial and tax law requirements or requirements of the Energy Industry Act or Metering Point Operation Act.

Transmission of personal data

If it is necessary to process your inquiries and to provide our services to you, we pass on the personal data collected to recipients in the following categories within the legal framework (e.g. as part of order processing)

  • Service providers for customer support
  • Credit institutions, payment service providers, debt collection agencies and lawyers
  • IT, postal and other communication service providers
  • Other companies of the MVV Energie Group
  • Public bodies and institutions (e.g. supervisory authorities, social security institutions, tax authorities, investigating authorities).

Further transmission will only take place if you have expressly consented to this in advance.

Duration of storage

Your data will be processed by us for the first time from the time it is collected, insofar as you or a third party provide it to us. We delete the data arising in this context after storage is no longer required, or restrict processing if there are statutory retention obligations.

Your rights

You have the right at any time to

  • a) to request information as to whether and which personal data concerning you are processed by us, Art. 15 GDPR
  • b) to request the rectification, erasure and restriction of processing of personal data concerning you, Art. 16 - 18 GDPR
  • c) to exercise your right to data portability, Art. 20 GDPR, and
  • d) to object to the processing of personal data concerning you, Art. 21 GDPR.

You also have the right to lodge a complaint with the competent supervisory authority.

Right to withdraw consent that has been granted

If you have expressly given us your consent to process your data, you are entitled to withdraw this consent at any time with effect for the future.

This also applies to the revocation of declarations of consent that you gave us before the GDPR came into force on May 25, 2018. The withdrawal of consent is effective for the future and does not affect the lawfulness of the data processed until the withdrawal. Use of Hubspot

Hubspot is an integrated software solution that we use to cover various aspects of our online marketing. These include, among others:
Email marketing, social media publishing & reporting, reporting, contact management (e.g. user segmentation & CRM), landing pages and contact forms.
Our registration service allows visitors to our website to learn more about our company, download content and provide their contact information and other demographic information. This information and the content of our website is stored on the servers of our software partner HubSpot. It can be used by us to contact visitors to our website and to determine which of our company's services are of interest to them. All information we collect is subject to this privacy policy. The legal basis for processing is your consent in accordance with Art. 6 para. 1 lit. a GDPR. If you do not want Hubspot to collect and process the aforementioned data, you can refuse your consent or revoke it at any time with effect for the future.
The personal data will be stored for as long as it is necessary to fulfill the purpose of processing. The data will be deleted as soon as it is no longer required to achieve the purpose.

As part of processing via HubSpot, data may be transferred to the USA. The security of the transfer is ensured by so-called standard contractual clauses, which guarantee that the processing of personal data is subject to a level of security that corresponds to that of the GDPR. If the standard contractual clauses are not sufficient to establish an adequate level of security, your consent may serve as the legal basis for the transfer to third countries in accordance with Art. 49 para. 1 lit. a GDPR.

Facebook

We operate a Facebook page on the basis of an "Agreement on joint processing of personal data" (see https://www.facebook.com/le gal/terms/page_controller_addendum) with Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. The processing of users' personal data is based on our legitimate interest in effectively informing users and communicating with them in accordance with Art. 6 para. 1 lit. f) GDPR. If the platform provider has obtained consent for data processing, the legal basis is Art. 6 para. 1 lit. a) and Art. 7 GDPR.

On the basis of our legitimate interests, i.e. our interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. GDPR. Use of cookies

Use of the Google Tag Manager

We use the Google Tag Manager on our website. This is an application from Google Inc. that enables companies to manage website tags via an interface. Tags are small code elements on websites that are used, for example, to measure traffic and visitor behaviour on websites and thus optimize the website. The Google Tag Manager application itself is a cookie-free domain that does not collect any personal data. The application triggers other tags, which in turn may collect data. However, Google Tag Manager does not access this data. If you do not want your website visit to be recorded by Google Tag Manager, you can deactivate it at domain or cookie level. This remains in place for all tracking tags that are implemented with Google Tag Manager.

The following tags are integrated on our websites via Google Tag Manager:

1. Google Marketing Services and Google Adwords Conversion

The "Google Marketing Services" of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, ("Google") are used on our pages.

With the help of Google Marketing Services, we can show users advertisements that are likely to match their interests. The term "remarketing" is used when a user is presented with advertisements for products that they have viewed on other websites.

To make this technically possible, a code from Google is executed directly on our website and on other websites (which use Google marketing services) and certain (re)marketing tags are integrated into the website (these can be invisible graphics or code snippets). This saves an individual cookie for the user (comparable technologies can also be used instead of cookies). These cookies contain information about which websites the user has visited and what they were interested in. In addition, technical information on the browser and operating system, referring websites, time and other information on the use of the websites and the IP address are stored.

The user data is processed pseudonymously. This means that Google does not store or process the user's name or email address, but processes the relevant data within pseudonymous profiles. (This does not apply if a user has expressly allowed Google to process the data without pseudonymization). The information collected by Google marketing services about users is transmitted to Google and stored on Google servers in the USA.

In the case of Google AdWords (online advertising program), each AdWords customer is assigned a different "conversion cookie". The cookie is used to create conversion statistics for AdWords customers. AdWords customers find out the total number of users who have clicked on their ad. However, they do not receive any information that can be used to identify users.

2 Google Analytics

We use Google Analytics in the "Google Analytics 4" version. Google Analytics 4 is a Google Analytics method in which users are analyzed using a pseudonymous user ID. This creates a pseudonymous profile of the user with information from the use of various devices (so-called "cross-device tracking"). 
The user's IP address is not logged and is shortened by the last two digits by default. The IP address is shortened on EU servers for EU users. In addition, all sensitive data collected from users in the EU is deleted before it is collected via EU domains and servers.
In this process, the transmitted IP address is not merged with other data held by Google. As with cookies in general, the storage of cookies can be prevented by a corresponding setting in the browser. Additionally or alternatively, the collection of information generated by the cookie and its processing by Google can be prevented by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

3 Facebook pixel, custom audiences and Facebook conversion

The so-called "Facebook pixel" of the social network Facebook is used on our websites, i.e. by Facebook Inc, 1 Hacker Way, Menlo Park, CA 94025, USA, or if you are based in the EU, by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Facebook can use the Facebook pixel to determine the visitors to our websites as a target group for the presentation of Facebook ads.

Accordingly, we use the Facebook pixel on our websites to present the Facebook ads placed by us only to those Facebook users who have already shown an interest in our websites or to whom certain "characteristics" are assigned (e.g. interest in topics or offers determined on the basis of websites visited). The Facebook pixel is also used to ensure that our Facebook advertising matches the interests of users and is not perceived as annoying.

The Facebook pixel is also used to statistically analyze how effective our Facebook ads are, as it allows us to see whether and how often users have clicked on our ads and been redirected to our website.

The data is processed by Facebook in accordance with Facebook's data usage policy. You can object to the collection by the Facebook pixel and the use of your data to display Facebook ads.
